By accessing our website, creating an account, or placing an order, you acknowledge that you have read, understood, and agreed to these Terms. By using this website or placing an order, you represent and certify that:

GunNerd may require government-issued identification, proof of age or residency, permits, licenses, a valid Federal Firearms License (“FFL”), or other documentation before accepting or processing an order.

 

You are responsible for knowing and complying with all federal, state, and local laws, regulations, and ordinances governing the purchase, possession, transfer, transportation, storage, installation, resale, and use of products purchased from GunNerd.

The availability of a product on our website does not mean that it is legal in your location. GunNerd does not provide legal advice, and website content should not be relied upon as a complete or current statement of the law. If you are uncertain whether a product or transaction is lawful, consult a qualified attorney or the appropriate government authority before ordering.

GunNerd may refuse, hold, or cancel any order that we believe may violate applicable law, carrier requirements, payment-processing rules, distributor requirements, manufacturer restrictions, or company policy.

 

The person identified as the purchaser must be the actual purchaser or lawful transferee of the firearm. You may not purchase or attempt to acquire a firearm for another person when doing so would misrepresent the identity of the actual purchaser, conceal the transaction, avoid a legal requirement, or provide a firearm to a prohibited person.

Orders suspected of involving a straw purchase, false statement, fraudulent transaction, unlawful resale, trafficking, or other illegal activity may be rejected, canceled, retained for review, and reported to the appropriate authorities.

Firearms purchased as legitimate gifts remain subject to all applicable laws and transfer requirements. GunNerd retains the right to determine whether it will accept or process a transaction.

 

Firearms will only be shipped to a valid FFL for transfer to the purchaser, except where another method is expressly permitted by applicable law.

Before a firearm order is processed:

Purchasing a firearm does not guarantee that the receiving FFL will legally transfer it. GunNerd is not responsible for the receiving FFL’s policies, fees, refusal to accept a shipment, or decision not to complete a transfer.

 

The purchaser must fully inspect the firearm at the receiving FFL before accepting the transfer. The purchaser should confirm:

If the firearm is incorrect, damaged, or materially different from the order, the purchaser must refuse the transfer and contact GunNerd before taking possession.

Once the receiving FFL completes the transfer and the purchaser takes possession, the firearm is considered accepted. Firearms accepted from the receiving FFL are not eligible for return unless GunNerd expressly agrees otherwise in writing. Subsequent defects and warranty matters will generally be handled through the manufacturer.

 

Payment for a firearm does not guarantee that the firearm can or will be transferred. GunNerd and the receiving FFL are not responsible for a background-check denial, delay, unresolved status, identification issue, residency issue, incomplete documentation, waiting period, or other legal restriction.

A purchaser who cannot complete the transfer remains responsible for applicable transfer fees, background-check fees, return shipping, shipping insurance, distributor charges, processing fees, and restocking or cancellation fees.

GunNerd does not control government background-check decisions and may not receive the reason for a denial or delay. Any challenge or appeal must be handled by the purchaser through the appropriate government agency.

 

Ammunition will only be sold and shipped where permitted by law. Certain jurisdictions may require ammunition to be shipped to an FFL, licensed ammunition vendor, or other approved location.

By ordering ammunition, you certify that:

Ammunition cannot be shipped to a P.O. box. Carrier restrictions apply, and an adult signature may be required. Ammunition is generally final sale and cannot be returned or exchanged except when GunNerd determines that an incorrect product was shipped or applicable law requires otherwise.

 

Certain firearms, magazines, ammunition, receivers, frames, components, knives, body armor, and other products may be restricted or prohibited in specific jurisdictions. You are responsible for confirming legality before ordering.

GunNerd may refuse or cancel a restricted order at its discretion. Applicable payment-processing, distributor, shipping, cancellation, or other costs already incurred may be deducted from a refund to the extent permitted by law.

GunNerd will not modify, disassemble, substitute, or alter a product to make it compliant unless expressly agreed to in writing before the order is placed.

 

If offered for sale, suppressors, short-barreled rifles, short-barreled shotguns, machine guns, destructive devices, and other items regulated under the National Firearms Act or other applicable laws are subject to additional documentation, taxes, approvals, waiting periods, and transfer requirements.

No regulated item will be released before all required approvals are received. Submission of an application does not guarantee approval. Unless otherwise required by law or expressly agreed to in writing, government taxes, application fees, transfer fees, and related processing charges are nonrefundable after submission.

 

An order confirmation only acknowledges that GunNerd received your order. It does not constitute final acceptance or create an obligation to sell or deliver a product.

Orders remain subject to:

GunNerd may accept, reject, limit, place on hold, or cancel an order at its discretion. If GunNerd cancels an order after collecting payment, the applicable refundable amount will be returned to the original payment method.

 

GunNerd makes reasonable efforts to maintain accurate pricing, photographs, descriptions, specifications, and availability. However, typographical errors, incorrect images, inventory discrepancies, distributor data errors, and manufacturer changes may occur.

GunNerd may correct an error, revise information, limit quantities, or cancel an affected order at any time. If an order is canceled because of an error after payment has been collected, the applicable amount will be refunded to the original payment method.

Product images may be representative. Colors, packaging, included accessories, markings, country of origin, and manufacturer specifications may change without notice. Unless a specific attribute is expressly included in the written product description, it is not guaranteed.

 

Payment must be completed through an accepted payment method. Billing information must match the information maintained by the payment provider.

GunNerd may request identification or additional documentation to verify a transaction. Orders suspected of fraud, unauthorized payment use, identity theft, straw purchasing, trafficking, or other unlawful conduct may be held, canceled, and reported to the appropriate payment provider or authorities.

Authorization of a payment does not constitute acceptance of the order. Temporary authorization holds and the timing of released funds are controlled by the customer’s financial institution.

 

The customer is responsible for all applicable sales, use, excise, transfer, permit, registration, and other taxes or government charges associated with an order. GunNerd will collect taxes when required. If a taxing authority later determines that additional tax is due, the customer remains responsible for the amount permitted by law.

 

Cancellation requests are not guaranteed. Once an order enters processing, is submitted to a distributor, is allocated, or is prepared for shipment, it may no longer be canceled.

Approved cancellations may be subject to payment-processing, distributor, shipping, cancellation, or restocking fees. Special orders, allocated products, firearms, ammunition, and regulated items may not be cancelable after processing begins.

 

Shipping eligibility, processing, delivery estimates, restricted destinations, FFL shipments, ammunition shipments, adult-signature requirements, address changes, damaged packages, missing shipments, and related charges are governed by GunNerd’s separate Shipping Policy, which is incorporated into these Terms by reference.

 

The customer is responsible for providing accurate delivery information and selecting a receiving FFL that will accept the shipment when applicable. Refused, unclaimed, undeliverable, or rejected shipments are handled under the Shipping Policy and Refund and Return Policy.

 

Eligibility, time limits, return authorization, final-sale products, firearm and ammunition restrictions, condition requirements, restocking fees, exchanges, defective products, cancellations, and refund timing are governed by GunNerd’s separate Refund and Return Policy, which is incorporated into these Terms by reference.

 

Special-order, allocated, discontinued, customized, distributor-direct, or limited-availability products may require full payment in advance and may not be canceled, returned, or exchanged.

Availability and estimated delivery dates are not guaranteed. Manufacturer and distributor delays are outside GunNerd’s control.

 

Transfers handled directly through GunNerd are subject to GunNerd’s separate FFL Transfer Policy, including identification, residency documentation, Form 4473, background checks, waiting periods when applicable, appointments, pickup, storage, denial, abandonment, and transfer-fee requirements.

A firearm will not be released unless all legal requirements and GunNerd policies have been satisfied. GunNerd may decline a transfer when permitted by law if the transaction presents a legal, safety, identification, fraud, or compliance concern.

 

Firearms, ammunition, and related products can cause property damage, serious injury, or death if handled improperly. Customers are responsible for:

GunNerd is not responsible for injury, damage, loss, or legal consequences caused by misuse, improper installation, negligent storage, criminal activity, unauthorized modification, reloaded or improper ammunition, failure to maintain a product, or use contrary to manufacturer instructions.

 

Customers are responsible for reviewing and following manufacturer recalls, safety notices, warnings, and operating instructions. GunNerd may contact customers concerning a recall or safety notice but does not guarantee that every notice will be received.

Customers should register eligible products with the manufacturer and regularly review manufacturer safety information. Recalled products must be handled according to the manufacturer’s or responsible government agency’s instructions.

 

Products may be covered by warranties provided by their manufacturers. Unless expressly stated otherwise in writing, GunNerd does not provide an additional product warranty.

Warranty claims may need to be submitted directly to the manufacturer. GunNerd may provide reasonable assistance or manufacturer contact information but does not control or guarantee the outcome of a warranty claim.

 

Promotions, discounts, coupon codes, store credits, and special pricing:

GunNerd may cancel an order involving an unauthorized, duplicated, altered, expired, or improperly applied promotion or discount.

 

Customers should contact GunNerd and make a reasonable effort to resolve an order issue before initiating a chargeback or payment dispute.

A chargeback does not eliminate responsibility for products received, transfer fees, shipping charges, restocking fees, or other valid amounts owed. GunNerd may provide transaction records, verification information, shipping records, delivery confirmation, communications, and FFL transfer documentation to the payment provider when responding to a dispute.

Fraudulent chargebacks may result in account termination, collection activity, and recovery of costs where permitted by law.

 

Firearms, ammunition, firearm components, optics, magazines, technical information, and related products may be controlled under United States export laws and regulations.

Products purchased from GunNerd may not be exported, re-exported, transferred internationally, or provided to a foreign person or prohibited destination without all required government authorizations.

Unless GunNerd expressly agrees in writing, all sales are intended for lawful use and delivery within the United States. Customers may not use a freight forwarder, export agent, international reshipper, or similar service to avoid these restrictions.

 

You may not:

GunNerd may restrict or terminate website access and report suspected criminal conduct to the appropriate authorities.

 

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You must promptly notify GunNerd if you suspect unauthorized access.

GunNerd may suspend or terminate an account for suspected fraud, unlawful conduct, abuse, policy violations, unauthorized payment activity, or inaccurate information.

 

If the website allows reviews, comments, photographs, or other customer-submitted content, you agree that your submission will be accurate, lawful, and will not infringe another person’s rights. You may not submit content that is threatening, defamatory, obscene, fraudulent, misleading, abusive, or commercially promotional without authorization.

You grant GunNerd a nonexclusive, royalty-free, worldwide license to display, reproduce, format, and use submitted content in connection with its website and business. GunNerd may remove submitted content at its discretion.

 

By using the website, creating an account, or placing an order, you consent to receiving transaction-related communications electronically, including order confirmations, receipts, shipping notices, FFL requests, verification requests, safety notices, policy notices, and legally required disclosures.

Electronic communications satisfy any requirement that a communication be provided in writing to the extent permitted by law. Marketing emails or text messages will only be sent according to applicable law and the customer’s communication preferences.

 

Personal information is collected, used, retained, and protected according to GunNerd’s separate Privacy Policy. By using the website, you acknowledge the practices described in that policy.

 

Website content, including text, photographs, graphics, logos, designs, product organization, and original materials, is owned by or licensed to GunNerd and is protected by applicable intellectual-property laws.

Content may not be copied, reproduced, distributed, modified, scraped, republished, or used commercially without prior written authorization. Limited printing or saving of order records and product information for personal, noncommercial use is permitted.

 

The website may use or link to third-party services, including payment processors, shipping carriers, manufacturers, distributors, FFL dealers, financing providers, and outside websites.

GunNerd does not control and is not responsible for the availability, content, security, privacy practices, policies, fees, representations, or performance of third-party services. Use of a third-party service may be governed by separate terms.

 

The website and its content are provided on an “as available” basis. GunNerd does not guarantee that the website will always be uninterrupted, secure, accurate, current, or free from technical errors.

To the fullest extent permitted by law, GunNerd disclaims implied warranties concerning the website and website content, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement. This disclaimer does not eliminate manufacturer warranties or customer rights that cannot legally be waived.

 

To the fullest extent permitted by law, GunNerd and its owners, employees, representatives, suppliers, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website, an order, product ownership or use, shipping delays, transfer denials, third-party services, data loss, or inability to use a product or the website.

To the fullest extent permitted by law, GunNerd’s total liability arising from a specific transaction will not exceed the amount the customer paid directly to GunNerd for the product or service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

 

You agree to defend, indemnify, and hold harmless GunNerd and its owners, employees, representatives, suppliers, contractors, and affiliates from claims, damages, losses, liabilities, judgments, penalties, costs, and reasonable attorneys’ fees arising from:

GunNerd is not responsible for a delay, cancellation, shortage, or failure caused by circumstances reasonably outside its control, including:

GunNerd may delay, allocate, modify, or cancel affected orders and refund amounts paid for products it cannot provide.

 

These Terms and any dispute arising from the website or a transaction will be governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Any legal action must be filed in a court of competent jurisdiction located in Maricopa County, Arizona, unless applicable law requires otherwise. You consent to the personal jurisdiction and venue of those courts.

 

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force and effect.

 

You may not assign your rights or obligations under these Terms without GunNerd’s written approval. GunNerd may assign its rights or obligations as part of a merger, sale, reorganization, transfer of assets, or operation of law.

GunNerd’s failure to enforce a provision does not waive its right to enforce that provision later. A waiver is only effective when made in writing by an authorized representative of GunNerd.

 

These Terms, together with the Privacy Policy, Shipping Policy, Refund and Return Policy, FFL Transfer Policy, and product-specific terms presented during checkout, constitute the entire agreement concerning your use of the website and purchase of products or services.

If a product-specific written term conflicts with these general Terms, the more specific term will control for that transaction.

 

GunNerd.US may revise these Terms at any time. Updated Terms become effective when posted unless otherwise stated. Your continued use of the website after an update constitutes acceptance of the revised Terms. The Effective Date at the top of this page identifies the latest revision.
